Land development, 14/11/2019

Land development track 1: - Land development projects are established by the Flemish Government in accordance with the decree of 28 March 2014 on land development. The area of the land development project is demarcated at the institution. One or more land development plans are drawn up for each land development project. The Flemish Land Agency applies land development to integrally design areas in accordance with the area designation (nature, agriculture, recreation, housing, etc.) that has been assigned according to spatial planning and provides a broadly applicable ' instrument case'. - Land development projects, established before the entry into force of the decree of 28 March 2014, are in implementation of Article 6bis and Articles 11 to 14 of the Decree of 21 December 1988 establishing the Flemish Land Agency. This decree defines the concept of 'land development' as 'Promoting, preparing, integrating and supervising measures, actions and works emanating from the competent authorities and aimed at safeguarding, revaluing and making rural areas more suitable, in accordance with the destination assigned by the spatial planning legislation.' One or more development plans were drawn up for each land development project. The new regulations of 2014 regarding land development provide a transitional arrangement for projects that were started before the date of entry into force of the new regulations. This transitional arrangement means that the development plans that have not yet been submitted to the mayor and aldermen for advice on November 1, 2014, will be drawn up as land development plans in accordance with the new regulations regarding land development. Land development track 2: Other authorities or partners of the Flemish Land Agency can also use the development instruments from the instrument case to achieve certain objectives on the site. Both the Flemish Government and the provincial or municipal level of government can decide to do this. The initiating body will then start working in consultation with the VLM. Instrument case: The instrument case can be widely used in the areas of design, management, land acquisition, land mobility and supporting policy. This includes, among other things, development works, reallocation and use exchange. Since the new legislation, this has included: reparcelling by force of law and right of pre-emption. These instruments have an extensive geographical component and are therefore included separately in the Land Development product dataset. In the land development brochure (https://www.vlm.be/nl/SiteCollectionDocuments/Landartikelen/Land development brochure web.pdf) you can read what land development is happening today. exactly what the different procedures are, and what the role of cities, municipalities, provincial governments, private individuals and the Flemish Land Agency is within land development.
