Flood plains are important areas for flood and water protection, which are to be preserved in their function as natural retention areas; they are determined on the basis of a flood event, which is statistically to be expected once in 100 years. Measures and changes to the surface of the earth within statutory flood areas require approval by the responsible authority in accordance with Section 78 of the Water Resources Act (WHG) and Section 113 of the State Water Act (LWG). As the upper water authority, the district government is responsible for determining flood areas. This is done by regulatory authority regulation according to § 112 LWG with the participation of the public (see § 76 WHG). The flood areas defined in this way are used, among other things, as a basis for municipal land use planning. In flood areas, there may be restrictions on building and, if necessary, further restrictions on use so that the water drainage is not impeded.
